A dismissal that does not follow fair procedures or lacks a valid reason.

Full Definition

Unfair dismissal occurs when an employer terminates an employee's employment without a valid reason or without following a fair procedure. In the UK, employees with 2+ years of continuous employment can bring an unfair dismissal claim at an Employment Tribunal. Valid reasons for dismissal include capability, conduct, redundancy, statutory illegality, and "some other substantial reason." Even with a valid reason, following a fair procedure is essential.
